Responsibility and Use & Disclaimer Warranties:
You, as a member, are responsible for the use of the borrowed items. You assume all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold Best Kept Secret, LLC harmless from and hereby release Best Kept Secret, LLC from, all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Best Kept Secret, LLC negligence, from the defective condition of the items, or any other cause. You agree that no warranties expressed or implied, including merchantability or fitness for a particular purpose have been made in connection with the equipment borrowed.
Members further agree that the items will only be used for the purpose for which it was intended and manufactured. ALL ITEMS ARE FOR CHILDREN 3 YEARS OF AGE AND OLDER and may have small parts/choking hazards. MEMBERS AGREE TO OVERSEE SUPERVISION OF THE USE OF ANY ITEMS THEY BORROW.
Item Responsibility: Members are responsible for borrowed resources from time of possession to time of return. Members assume the entire risk of loss, regardless of cause. If items are lost, stolen, damaged, members will assume the cost of replacement.
Pickup & Return: All items must be picked up and returned in-person at selected pick-up or delivery time.
Payment/Cancellation: Memberships will automatically renew monthly. All membership cancellations must be made prior to the next billing cycle. No refunds will be given. Once canceled, members can continue to borrow items until the end of the membership term. All items must be returned at that time. If items are not returned by the end of the agreed membership term, members will be automatically charged for the replacement of the items in their possession through their credit card on file.
